 Inquest into Encounter Bay deaths handed down

Deputy coroner Jayne Basheer has released the inquest report into the the 2014 murder of Encounter Bay woman Grazilla Dailler.


No recommendations have been made as a result of the report but it raises concerns over mistakes made by SAPOL in documenting incidents of domestic violence in the years leading up to Ms Dailler’s death.


Ms Dailler was murdered by her former partner Dion Muir, who then took his own life.


Concern was first raised on 15 May 2014 when Ms Dailler did not attend work at the Authenticity Wellness Retreat in Port Elliot. 


Her adult daughters visited her home at Nicolas Baudin Drive the next day. Ms Dailler's car was in the driveway but there was no response from inside the house. Emergency services were called and an ambulance officer entered the home and discovered the bodies of Ms Dailler and Mr Muir.


Ms Dailler died as a result of stab wounds and head injuries.  


The inquest report details a history of reports of abuse, violence and threats by Mr Muir against Ms Dailler and against his former wife.


The deputy coroner notes that, “notwithstanding Ms Dailler’s courage in finally reporting acts of domestic abuse, including historical offending, attempted strangulation, savage beatings and the like, she was unable to maintain her resolve to hold Mr Muir accountable for his actions.”


She says however that neither Ms Dailler nor any other victim of domestic abuse should be criticised for such decisions. She notes that the factors that lead victims to act in this way are complex and included psychological factors beyond the scope of the inquest.


Ms Basheer also expressed concern with the documentation of several incidents of abuse.


“The number of times that incident documentation has fallen short in this case is disconcerting. If SAPOL members cannot appreciate the importance of rigorous compliance with General Orders in the context of domestic abuse, there is a problem.”


However, she says that any shortcomings identified in the handling of the incidents leading up to the deaths did not contribute in any substantial way to the outcome.
